END USER LICENSE AGREEMENT

Please read this agreement carefully before using Timeline Software. By clicking the “I Agree” button, downloading or using the Timeline Software, you are agreeing to the terms and conditions of this End User License Agreement (“EULA”). If you do not agree with the terms of this EULA, do not download, install or copy Timeline Software, and cease all use of Timeline Software.

Timeline Software may contain associated components, documentation, sample files, templates, bundled media, resource files and other supplements (“Timeline Software”).

Subscriptions

Historytimeline.com grants you a non-exclusive, non-transferable license to use Timeline Software. If you comply with this EULA, you have the rights below for each subscription you acquire.

Free Version

You may install and use Timeline Software on more than one computer. The Free Version license has no time limits. Cancelling your paid subscriptions will revert your copy of Timeline Software to Free Version with limited access to features and contents.

Personal Subscription

You may install, activate and use one (1) copy of Timeline Software. Subscription license keys must be activated in a computer the usage of which is predominantly by a single personal user.

Professional Subscription

You may install, activate and use two (2) copies of Timeline Software. License keys must be activated in computers the usage of which is predominantly by a single user.

Additional (volume) activations related to a professional subscription must be used for illustrative and educational purposes within institution and institution-related activities. Volume activations are reusable for the period of subscription validity.

Perpetual Subscription

You may install, activate and use two (2) copies of Timeline Software. You shall not use Timeline Software on more than one computer at the same time. The perpetual subscription grants a non-expiring lifetime license to use the software. It also grants software updates and customer support for 5 years.

Users may make an additional copy of Timeline Software for archive and backup purposes.

Payments

Timeline Software subscriptions will be billed in advance on a yearly basis until cancellation. You may cancel a subscription at any time and continue to enjoy the benefits until the end of the subscription’s period.

Subscription Renewals

To provide an uninterrupted service, our subscriptions are renewed automatically. Unless you cancel your subscription before the end of the subscription period, it will renew automatically. You authorize us to invoice you and collect the applicable subscription fee (including taxes) using the payment mechanisms we have on record for you.

Subscription Cancellations

You can cancel a subscription by signing in to historytimeline.com. We recommend that you use our web interface to ensure immediate subscription cancellation. Cancellations submitted 2 days prior to the rebilling date may not effectively terminates the subscription before the imminent payment due to automatic payment processing. You may also contact us by email to cancel your subscription. We cannot fully guarantee receipt of any emails, for this reason, if you send an email request for cancelling a subscription, please make sure to receive a cancellation confirmation from us.

Money-back guarantee

Your satisfaction is very important to us. Subscriptions include a 30 days money-back guarantee for any Timeline Software issue that would prevent installation or the normal operation of the software. Before requesting a refund, you agree to contact support and follow the instructions provided, if any. Refunds will be issued at our sole discretion only after acceptable proof is provided. We will provide a replacement for any damaged installer and Timeline File downloads.

Warranty and Liability

THIS SOFTWARE IS PROVIDED “AS IS’” AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT HISTORYTIMELINE.COM SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS, OR BUSINESS INTERRUPTION, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT, INCLUDING NEGLIGENCE OR OTHERWISE, ARISING IN ANY WAY OUT OF THE USE OF THE TIMELINE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

SUBSCRIPTION CANCELLATION MAY CAUSE LOSS OF CONTENTS AND LOSS OF ACCESS TO CONTENTS AND FEATURES OF TIMELINE SOFTWARE. WE DO NOT ACCEPT ANY LIABILITY FOR SUCH LOSSES.

Historytimeline.com does not accept any responsibility or liability for the accuracy, reliability or completeness of the contents provided.

Contents provided by historytimeline.com may have links to sites run by independent third-parties. These third-party sites are freely available online and as such, links are offered free of charge for your convenience only. The links provided should not be interpreted in any way as an endorsement, authorization, or sponsorship of the third-party sites or the companies that operate them. Historytimeline.com cannot be held responsible for the accuracy, copyright compliance, legality, or decency of material contained in third-party sites. If you decide to access any of the third-party sites, you do this at your own sole risk.

Amendments & Termination

Historytimeline.com reserves the right to modify or replace this EULA at any time. Continued use of the Timeline Software following the notice of any changes to this EULA constitutes acceptance of those changes. Historytimeline.com also reserves the right to modify, suspend or discontinue Timeline Software and any related service temporarily or permanently.

Any provision of this EULA held to be unenforceable or invalid will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law. All other remaining provisions will continue in full force and effect.

This Agreement shall remain in effect until expiration of all copyright interests in the Timeline Software, unless earlier terminated. If you fail to comply with with any provision of this EULA, without prejudice to any other rights, historytimeline.com might terminate this EULA agreement and services provided. Historytimeline.com may terminate your access to Timeline Software and related contents, without notice, effective immediately.

Intellectual Property & Copyright

Timeline Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws. historytimeline.com retains any rights of the software present in the output of the Software.

Free and premium files published in the Timeline List, including their components, from now on ‘Timeline Files’, are copyrighted works property of historytimeline.com and its suppliers. Timeline Files are to be used in conjunction with Timeline Software. Terms and Conditions of Timeline Software apply to the use of Timeline Files. Below you have the rights for each subscription you acquire.

Free Version & Personal Subscriptions

You may freely navigate and change Timeline Files settings and parameters within the Timeline Software framework that suit best your needs to enjoy your user experience. You may extract using “Save as Picture”, “Export As” and “Print” for your personal use. You may distribute non-significant parts, under 10% of each Timeline File contents, according to the principles of “fair use” in copyright law.

Professional, Volume Licensing & Perpetual

In addition, you may internally distribute for illustrative and educational purposes within institution, up to 120 print or digital copies per license, per year, in whole or in part of each Timeline File. The number of digital copies may be determined by the number of users with granted access to the resource. For the perpetual license, distribution rights extend for a period equal to the support included in the license.

Distribution Rights

Distribution rights are granted for hard-copy renditions or static electronic Timeline File images that are distributed with proper metadata and source/copyright attribution. Distribution or commercial use of Timeline Files is at no time permitted, except with express written permission by historytimeline.com. Occasionally, additional terms may accompany and apply to specific Timeline Files.

Reporting Copyright Infringement

If you are a copyright owner or agent thereof and believe that any contents provided by historytimeline.com constitute an infringement of copyright, please submit written notice, with the following information:

Signature of the person authorized to act on behalf of the owner of the copyright;
Description of the copyrighted work that you claim has been infringed;
Website, software or contents locations that contain the material that you claim is infringing;
Contact information for the notifying party, including name, address, telephone nº and e-mail address;
Good faith statement by you that the disputed use is unauthorized by the copyright owner, or by law;
Statement by you that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Jurisdiction

This EULA shall be governed by the laws of Spain. Without prejudice to the rights that could assist you as a consumer, any dispute relating to the use of Timeline Software and related contents shall be subject to the exclusive jurisdiction of the pertinent Spanish courts.
